MaxAI Terms of Service

Welcome to MaxAI.

"MaxAI" refers to the official websites of MaxAI and its affiliated platforms, which are legally owned and operated by HK PANSYS LIMITED and its affiliates (hereinafter referred to as "we", "us", or "the Company"). It also includes products and services provided through MaxAI or its affiliated platforms, including but not limited to Software Development Kits (SDKs), Application Programming Interfaces (APIs), and other related technologies made available to third-party platforms and applications.

1. Introduction

1.1 These Terms of Service (the "Terms") constitute a binding agreement between you and us regarding your use of MaxAI and related services. Please note that all other policies, rules, guidelines, announcements, and in-app notifications issued or modified by us from time to time (collectively, the "Platform Rules") form an integral part of these Terms and have the same legal effect. We will provide you with prominent notice of any material changes to the Platform Rules. If you do not understand or accept any revised provision, you may contact our customer service for clarification. If you still disagree with the changes after such consultation, you must stop using MaxAI as of the effective date of the changes. Your continued use of MaxAI after the effective date constitutes your full understanding and acceptance of the revised terms.

1.2 Please read these Terms carefully, particularly the provisions regarding limitation of liability, privacy policy, account rules, governing law, and dispute resolution (including jurisdiction).

1.3 MaxAI is intended for adults. If you are under 18, you must review these Terms — especially the provisions regarding minors — with your parent or legal guardian and obtain their consent before using MaxAI.

1.4 By clicking "Register" on the webpage or by actually using MaxAI, you acknowledge that you have fully read, understood, and agreed to all provisions of these Terms, which shall be legally binding on you. If you do not agree with or understand any provision, do not proceed with registration.

2. MaxAI Products and Services

2.1 These Terms apply to your access to and use of AI content generation features and services provided by all forms of MaxAI products, including but not limited to model training, content generation, information publishing, interactive communication, and search queries.

2.2 MaxAI provides AI-powered applications such as text-to-image, text-to-video, and image-to-video generation. It is designed to inspire and assist visual content creators — including illustrators, designers, and artists — in their creative work, and also supports personalized AI content creation for general users.

2.3 We grant you a personal, revocable, non-transferable, and non-exclusive license to use MaxAI. All rights not expressly granted under these Terms are reserved by us. Without our prior written consent, you may not use MaxAI in any unauthorized manner, including but not limited to copying, distributing, adapting, crawling, vertical searching, mirroring, or commercializing any part of the service.

3. MaxAI Account

You understand and acknowledge that, before registering for and using the MaxAI platform services, you shall possess the corresponding civil capacity required for your actions under applicable laws.

If you do not have the civil capacity appropriate for your actions, you shall carefully read and fully understand this Agreement together with your legal guardian, and obtain the consent of your legal guardian before registering for and using the MaxAI platform services. You and your legal guardian shall be responsible for all consequences arising from your registration and use of the MaxAI platform services.

3.1 Account Registration

3.1.1 To use MaxAI, you must register using your real-name mobile phone number or a third-party account approved by us (such as a Google account or email). You may be required to provide certain necessary information. You authorize us to verify and reasonably use your necessary personal information to ensure the security, effectiveness, and continuous improvement of the service. You warrant that all information you provide is true, accurate, and complete. Failure to provide accurate information may result in restricted access or inability to use certain features. You shall be solely responsible for any liability or loss arising from inaccurate, incomplete, or false information.

3.1.2 Your registered account is for your personal use only. You may not use it for illegal purposes or to harm others. Malicious bulk registration is prohibited. Without our written consent, you may not gift, lend, rent, transfer, sell, or otherwise permit others to use your account. If we discover or reasonably suspect that the account is being used by someone other than the original registrant, we may immediately suspend or terminate service to the account and permanently disable it for security reasons.

3.1.3You may access and use certain basic functions of MaxAI without registering or logging into an account. However, certain features and services may not be available to you in such circumstances.

To use certain functions and/or individual services, including but not limited to AI content generation, content publishing, and user interaction features, you must register for or log into a MaxAI account. If you decline to provide the required information during the registration or login process, we may not be able to provide you with such features or services.

3.1.4 If you provide any information that is illegal, immoral, or otherwise inappropriate for display on MaxAI, or if we reasonably suspect that your information is generated by automated programs or malicious operations, we reserve the right to suspend or terminate your account and refuse you access to all or any part of MaxAI now and in the future.

3.1.5 We and the MaxAI platform assume no responsibility for any user's registration information, including but not limited to verifying the authenticity, accuracy, completeness, applicability, or timeliness of any registration data.

3.1.6 You are responsible for safeguarding your account username, password, and verification codes. Any activity conducted using your account credentials shall be deemed your own actions, and electronic records generated thereby shall serve as valid evidence of your conduct.

3.1.7 You may apply to cancel your MaxAI account if you understand and agree to the following conditions:

(1) You may only cancel your own account. Please email support@joinpay.com to initiate the cancellation process;

(2) You remain responsible for all actions taken under your account prior to cancellation;

(3) After account cancellation, we will delete or anonymize your account information, except as otherwise required by law or regulation. You will no longer be able to log in or retrieve any content or data associated with the account.

3.1.8 In accordance with applicable laws and regulations, if your account remains inactive for more than six consecutive months, we reserve the right to freeze or reclaim the account. Once frozen or reclaimed, the account cannot be logged into or used, and all saved data and usage records will be irrecoverable. We will provide you with appropriate notice before freezing or reclaiming your account.

3.2 Account Security

Protecting the security of your account is your responsibility. You agree that:

3.2.1 You are fully responsible for all activities conducted under your account, including any data modifications you make on MaxAI. You must keep your account and verification codes strictly confidential and never disclose them to anyone. If you discover any unauthorized use of your account or any other security breach, you must notify us immediately. Except for our statutory fault, we shall not be liable for any losses resulting from delayed notification.

3.2.2 We are not and shall not be responsible for any losses or damages resulting from your failure to properly safeguard your account and verification codes.

3.2.3 You are responsible for maintaining the security and confidentiality of your account and verification codes, and you bear full legal responsibility for all activities conducted in your account name. If you cause harm to yourself, us, or any third party due to your failure to safeguard your account and verification codes, you shall bear full liability.

3.2.4 You may not transfer or authorize others to use your account in any form. MaxAI shall not be liable for losses or consequences resulting from your voluntary disclosure, lending of account information, or from your being subject to hacking, fraud, or other attacks. You may seek remedies against the infringing party through judicial or administrative channels.

3.3 Unified Account Service

3.3.1 Unless otherwise specified, all MaxAI affiliated platforms share a unified account service. Your MaxAI account works across all affiliated platforms, and content published under your account will be synchronized across them. When you log in and use affiliated platform services with your MaxAI account, you are bound by both these Terms and the user agreements and platform rules of the affiliated version (if any). In the event of inconsistency, the user agreement and platform rules of the affiliated platform shall prevail.

3.3.2 To improve the efficiency and visibility of the content you generate and publish, you authorize us to automatically synchronize all content published under your MaxAI account to other software and websites we operate. Your public profile information — such as your avatar and nickname — may be synchronized along with your content.

3.3.3 To maintain platform order and a positive community atmosphere, we may implement coordinated enforcement measures across MaxAI affiliated platforms. For example, if you are penalized for violating laws or these Terms on MaxAI, your access to services on affiliated MaxAI platforms may also be affected, and vice versa.

4. User Personal Information Protection

4.1 Respecting user privacy and protecting the security of your personal information is a fundamental commitment of ours. We will take reasonable measures to protect your personal information and privacy. We promise that, without your consent, we will not collect or use personal information beyond what is necessary to provide our services, nor will we use it for purposes unrelated to service delivery. In addition to the personal information protection and privacy provisions expressly set forth herein, we encourage you to carefully read our Privacy Policy, which is specifically designed for the platform and updated from time to time, to better understand how we protect your personal information.

You acknowledge and agree that, for your convenience in using MaxAI services, we have the right to obtain, use, store, and share your personal information in an explicit manner in compliance with laws and regulations. We will not disclose, edit, or reveal your personal information or non-public content stored on MaxAI without your authorization.

You acknowledge and agree that we may collect product/service usage and behavioral data through cookies and similar technologies, and may freely use desensitized commercial data that no longer identifies or is linked to your personal identity.

You may contact customer service or email support@joinpay.com to request access to, copying of, correction of, supplementation of, or deletion of your personal information. Identity verification is required during the process. Upon successful verification, we promise to complete the review and processing within a reasonable period (e.g., 30 business days).

4.2 We will employ various security technologies, procedures, and management systems to protect your personal information from improper use, unauthorized access, use, or disclosure.

4.3 Without your consent, we will not disclose your personal information to any other third party, except:

(1) When required by applicable laws, regulations, judicial authorities, or administrative agencies;

(2) When transferred as part of a merger, division, acquisition, or asset transfer;

(3) When necessary to provide the services you have requested;

(4) As otherwise permitted under the Privacy Policy or other applicable agreements.

5. User Code of Conduct

5.1 You agree to use MaxAI responsibly and in compliance with these Terms and all other policies, rules, and announcements issued by us from time to time. You are solely responsible for your use of MaxAI. Unless permitted by law or with our prior written consent, you may not engage in any of the following prohibited activities:

5.1.1 Using any unauthorized plug-ins, cheats, systems, or third-party tools to interfere with, disrupt, modify, or otherwise affect the normal operation of MaxAI.

5.1.2 Engaging in any activity that endangers computer network security against or using MaxAI, including but not limited to:

(1) Activities endangering network security such as illegal intrusion, interference with normal network functions, or theft of network data; using MaxAI to publish, transmit, disseminate, or store content that endangers national security, national unity, or social stability; content that is insulting, defamatory, pornographic, violent, or otherwise disturbing; or any content violating Chinese laws and regulations; or using usernames or character names containing such content; publishing, transmitting, or disseminating illegal advertising, marketing, or spam information; using MaxAI to infringe on others' intellectual property rights, portrait rights, privacy rights, reputation rights, personal information, or other legitimate rights and interests;

(2) Providing programs or tools specifically designed for activities endangering network security, including but not limited to: using unauthorized data or accessing unauthorized servers/accounts; accessing public computer networks or others' computer systems without permission and deleting, modifying, or adding stored information; attempting to probe, scan, or test vulnerabilities of the "software" system or network without permission; attempting to interfere with or disrupt the normal operation of the "software" system or website; deliberately spreading malicious programs or viruses; forging TCP/IP packet names or parts thereof; uploading any viruses, Trojans, worms, or other harmful content;

(3) Providing technical support, advertising, payment settlement, or other assistance to persons you know are engaged in endangering network security activities;

(4) Using unauthorized data or accessing unauthorized servers/accounts;

(5) Accessing public computer networks or others' computer systems without permission and deleting, modifying, or adding stored information;

(6) Attempting to probe, scan, or test vulnerabilities of the MaxAI platform or network without permission;

(7) Attempting to interfere with or disrupt the normal operation of the MaxAI platform, deliberately spreading malicious programs or viruses, or otherwise disrupting normal network information services;

(8) Reverse engineering, reverse assembling, compiling, or otherwise attempting to discover the source code of MaxAI; modifying or disabling any functions of the software or website without permission, or creating derivative works based thereon; removing any proprietary notices or labels from MaxAI software or documentation, or merging other software with MaxAI;

(9) Maliciously registering or using MaxAI accounts, including but not limited to frequent or bulk registration, renting or lending accounts to others, multi-client/multi-IP login, excessive model downloads beyond reasonable usage, or any behavior that undermines service fairness or disrupts normal application order — such as active or passive score manipulation, collusion, using cheats or other cheating software, exploiting bugs to obtain improper benefits, or publicizing cheats, cheating software, or bugs via the internet or other means;

(10) Any other conduct violating laws, these Terms, our rules, or infringing on others' legitimate rights and interests.

If we reasonably believe your conduct violates or may violate the above, we may independently assess and take action. We reserve the right to terminate service to you at any time without prior notice and pursue legal liability as appropriate.

5.1.3 Content standards: To foster a healthy online ecosystem, protect the legitimate rights and interests of citizens, legal persons, and other organizations, and safeguard national security and public interests, we will carry out activities such as promoting positive energy and addressing illegal and harmful information in accordance with laws and administrative regulations. You also undertake to abide by laws and regulations, national interests, citizens' legitimate rights and interests, public order, social morality, and information authenticity.

5.2 You agree that any content you download, access, or use from us or other users is at your own risk and is subject to these Terms and/or any terms accompanying such content:

5.2.1 Without our written permission, no user or third party may directly or indirectly steal models, images, articles, or other information content of MaxAI through any means (including but not limited to hotlinking, redundant theft, illegal crawling, simulated downloading, deep linking, fake registration), or delete or alter rights-management electronic information of relevant content (including but not limited to hiding or modifying domain names, platform-specific identifiers, usernames, etc.).

5.2.2 With our written permission, sharing, reposting, or other use of MaxAI content by users or third parties must also comply with the following specifications:

(1) Relevant search keywords, content categories, search volume, download volume, collection volume, and other related data obtained through crawling or statistics may not be publicized, provided, or disclosed to any third party without our prior written consent;

(2) No modifications of any kind may be made to the source pages of MaxAI services, including but not limited to homepage links, tool links, and other entry points; nor may the display of source pages be obstructed, inserted with pop-ups, or otherwise interfered with;

(3) Safe, effective, and strict measures must be taken to prevent MaxAI content from being illegally obtained by third parties through any means including but not limited to spider programs;

(4) Relevant data content may not be used for purposes beyond the scope of our written permission, for any form of sale or commercial use, or disclosed, provided to, or made available for use by third parties in any manner.

5.3 You shall respect privacy and ethics, protect data security, and may not input or share any unauthorized personal information, confidential information (including but not limited to trade secrets), or other unauthorized information. You shall respect the legitimate rights and interests of others, ensure that all content you input is legal and compliant, owned by you, or properly licensed. You may not input or share any unauthorized content, infringe on others' intellectual property rights, personality rights, or other rights; impersonate others to commit infringement or other illegal activities; or use new technologies and applications based on deep learning, virtual reality, or generative AI to generate, produce, publish, or spread rumors, false information, or other illegal content.

5.4 To inform users that content is generated by artificial intelligence, we will add AI-generated content labels in accordance with legal requirements — including visible watermarks on generated content and invisible metadata embedded through technical means that can be extracted and identified — to prevent public confusion or misidentification. Please carefully read and understand the labeling requirements under relevant laws, regulations, and mandatory national standards such as the Measures for Labeling AI-Generated Synthetic Content and the Cybersecurity Technology — Labeling Methods for AI-Generated Synthetic Content. You may not cover, smudge, modify, or remove any labels we add to AI content in any manner.

5.5 You may apply for generated content without visible labels in accordance with the MaxAI Watermark Specification, and shall yourself add alternative prominent labels during use to indicate that the content is AI-generated.

5.6 Information and content you create, comment on, publish, or disseminate (including but not limited to models, images, comments uploaded to MaxAI) must comply with laws and regulations, national interests, citizens' legitimate rights and interests, public order, morality, and information authenticity. Otherwise, we reserve the right to immediately take measures including content deletion and account suspension. You agree and undertake not to create, reproduce, publish, or disseminate content that:

Opposes the basic principles established by the Constitution;

Endangers national security or discloses state secrets;

Subverts state power, incites separatism, or undermines national unity;

Damages national honor and interests;

Advocates terrorism or extremism;

Advocates ethnic hatred or discrimination, undermining ethnic unity;

Incites regional discrimination or hatred;

Undermines national religious policy, or promotes cults and feudal superstition;

Fabricates or spreads rumors or false information, disrupting economic or social order and undermining social stability;

Distributes or disseminates obscenity, pornography, gambling, violence, homicide, terror, or incites crime;

Endangers cybersecurity or uses the network to engage in activities endangering national security, honor, or interests;

Insults or defames others, infringing on their legitimate rights and interests;

Threatens violence against others or conducts doxxing;

Involves others' privacy, personal information, or data;

Spreads obscenities or damages public order and good morals;

Infringes on others' privacy rights, reputation rights, portrait rights, intellectual property rights, or other legitimate rights and interests;

Distributes commercial advertisements or similar commercial solicitation, excessive marketing, or spam;

Uses languages other than the primary language of this website for comments;

Is completely unrelated to the information being commented on;

Is meaningless or deliberately uses character combinations to evade technical review;

Infringes on minors' legitimate rights and interests or harms their physical and mental health;

Secretly photographs or records others without permission, infringing on their legitimate rights;

Contains terrorist, violent, bloody, or high-risk content endangering the performer's or others' physical and mental health, including but not limited to:

Content depicting any violent and/or self-harm behavior;

Content threatening life or health, or performances using dangerous instruments such as knives that endanger personal or property rights;

Content encouraging or inducing others to participate in dangerous or illegal activities that may cause personal injury or death;

(24) Other information containing content that violates laws, regulations, policies, or public order and good morals, interferes with the normal operation of the MaxAI platform, or infringes on the legitimate rights and interests of other users or third parties.

5.7 We have established complaint and reporting channels. You may report illegal and harmful behavior through our designated reporting channels. We will promptly accept and handle your complaints and reports to help foster a clean and positive online environment.

6. Intellectual Property Rights

6.1 You acknowledge and agree that all code, trademarks, service marks, trade names, graphics, artwork, photographs, portraits, text, audio, video, button icons, computer software, logos, digital downloads, data compilations, and other content contained in the services provided by the MaxAI platform are the property of us or our content providers, protected by copyright, trademark, and other property ownership laws and regulations of the People's Republic of China. You may not engage in any activity that infringes on the intellectual property rights or other rights and interests of us or any third party.

6.2 You acknowledge and agree that, unless otherwise agreed, ownership, intellectual property rights, and other legal rights in user content you upload and publish through the MaxAI platform belong to you or your licensors. To enable better sharing and promotion of user content and enhance its dissemination value and influence, you agree and/or ensure that the actual rights holder agrees:

6.2.1 You warrant that all content you upload and publish when using MaxAI services (including but not limited to models, text, images, audio, video, and all components thereof such as music, sound, dialogue, visual design, and conversation) is original by you or properly licensed (including sub-licensing), and does not infringe on any third party's intellectual property rights. You own the content you generate online using the MaxAI platform; intellectual property and other property rights in such generated content belong to you or the relevant rights holders.

6.2.2 With your authorization, we may, when necessary and in our own name or through a professional third party, enforce intellectual property rights on your behalf against infringers of content you upload and publish. Enforcement measures include but are not limited to monitoring infringement, sending cease-and-desist letters, and filing lawsuits or arbitrations.

6.2.3 You retain ownership, control, and responsibility for content you publish or otherwise provide on MaxAI. Your content must not violate these Terms, applicable laws, or regulations, nor infringe or misappropriate any rights of any person or entity. If we suspect your content violates the foregoing, we may delete your content at any time at our sole discretion. If you disagree with the result, you may contact us via the channels provided in these Terms and provide supporting materials for resolution.

6.2.4 When you generate images or other content using MaxAI, the generation interface and generated image/video display area will bear a brand watermark reading "Content generated by MaxAI." When downloading images/videos, you may choose an AI brand watermark style and save accordingly.

6.2.5 You shall use the service as a creative aid in good faith. If you intend to publicly distribute, disseminate, or commercially use generated content, you shall conduct necessary due diligence to ensure compliance with applicable laws and regulations, and seek professional legal advice when necessary, to minimize intellectual property infringement risks.

6.2.6 To continuously improve MaxAI services, for any files or content you input, generate, or upload to MaxAI (including but not limited to models, images, training data), you expressly grant us a worldwide, perpetual, royalty-free, non-exclusive, multi-level sublicensable right to use, display, download, and/or distribute such files or content and derivative works created therefrom in any form and media now known or hereafter developed, or assets generated in accordance with your instructions. This license covers MaxAI and our other related business platforms, including but not limited to promoting and redistributing part or all of the services (and their derivative works) in any media format and through any media channel, improving and enhancing our AI models and product services, and ensuring service security and stability. If you do not wish us to use your content for the aforementioned purposes, you may contact us through the feedback page or by emailing support@joinpay.com.

6.3 When content contains reasonable and customary license notices (e.g., open source licenses), such content shall be subject to the terms of such license when further accessed, distributed, or used. Neither party may remove references to any such license.

7. Breach and Remedies

7.1 For any violation of these Terms or other service terms by you, we reserve the right to independently assess and take appropriate measures, including but not limited to warning, refusal to publish, immediate cessation of information transmission, deletion of content or comments, temporary ban on publishing, restriction of some or all account functions, termination of service, or permanent account closure. We shall not be liable for any resulting inability to use your account or related services, or inability to access assets or other benefits within your account. We may announce the results of enforcement actions and decide whether to restore account access based on the circumstances. For conduct suspected of violating laws or constituting a crime, we will retain relevant records and may report to competent authorities, cooperate with investigations, or report to public security organs in accordance with the law. Deleted content may not be recoverable.

7.2 We respect and protect the intellectual property rights, reputation rights, name rights, privacy rights, and other legitimate rights and interests of users and others. You warrant that text, images, models, or other content you upload or generate using other users' models does not infringe on any third party's intellectual property rights, reputation rights, name rights, privacy rights, or other legitimate rights and interests. Otherwise, we reserve the right to remove allegedly infringing content upon receipt of notice from the rights holder or relevant party. You shall handle all third-party claims on your own and bear all resulting legal liabilities. If our affiliates, controlling entities, successor entities, or other users suffer losses (including but not limited to economic and reputational losses) as a result of your infringement, you shall fully compensate for all such losses.

7.3 You are solely responsible for your use of MaxAI. You shall indemnify and hold us and our related parties harmless from all liabilities and expenses (including attorneys' fees) arising from your use (or inability to use) of the services — including but not limited to your violation of these Terms or applicable laws, any content or data you publish or use, and any other party's use of your content for any service — except to the extent that a claim directly arises from our fraud, gross negligence, or willful misconduct.

7.4 You agree that we may, as an independent third party, make investigation and handling decisions independently based on the facts known to us and in accordance with MaxAI dispute resolution rules, applying the standard of care of an ordinary person. If you are dissatisfied with a decision, you may pursue other legal remedies. However, pending a final resolution through other channels, you agree to comply with the investigation and handling decision first.

7.5 If we discover, or receive reports or complaints from others regarding, your violation of these Terms or applicable laws and regulations, we reserve the right to take measures including warning, freezing, termination/suspension/restriction of account functions, rescission or termination of this Agreement, or claiming damages.

8. Scope and Limitation of Liability

8.1 Our services are provided on an "as is" and "as available" basis. We expressly disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-interruption, accuracy, or reliability.

8.2 Given the current limitations of technology and the principles of AI generation, we cannot guarantee the authenticity, accuracy, reliability, or uniqueness of generated content. Results for the same or similar input may vary. Accordingly, we make no warranties regarding generated content. You shall independently and prudently evaluate and verify generated content. All consequences and liabilities arising from decisions you make or actions you take based on generated content — including risks related to authenticity, accuracy, reliability, uniqueness, or non-infringement — shall be borne solely by you. We take content safety seriously and strive to filter inappropriate or harmful model outputs through reasonable security measures, but we cannot completely eliminate errors. If you encounter such issues, please notify us promptly and we will address them and continue to optimize our services.

8.3 We perform our basic security obligations in accordance with law, but we shall not be liable for any impediment to performance, defective performance, delayed performance, or modification of performance content caused by any of the following:

(1) Force majeure events such as epidemics, typhoons, earthquakes, tsunamis, floods, power outages, wars, terrorist attacks, or judicial/administrative orders;

(2) Public service failures such as power supply or communication network failures, or third-party causes;

(3) Equipment maintenance, equipment or system failures, network information, or data security issues, provided we have exercised good faith management.

8.4 We do not guarantee the truth, accuracy, or completeness of any information, content, or advertisements obtained from third parties or other users through MaxAI (collectively, "Information"), except as expressly required by law. You fully understand and agree that, given the nature of the internet, information you publish or share using MaxAI may be copied, reposted, tampered with, or otherwise misused by others. You acknowledge these risks and agree to bear them entirely. We shall not be liable for any direct, indirect, incidental, or consequential losses arising from any transactions or conduct not directly with us.

8.5 We have the right to review and handle illegal and non-compliant content in accordance with applicable laws, these Terms, and platform rules, but this right does not constitute an obligation or commitment. We cannot guarantee timely detection or handling of violations.

8.6 Except for final judicial judgments, we shall not be liable for any indirect, incidental, special, or punitive damages arising from MaxAI services, even if advised of the possibility of such damages.

9. Minors

9.1 If you are under 18 years of age, you may only use MaxAI after carefully reading and agreeing to these Terms under the guardianship and guidance of your parent or legal guardian and with their consent. The platform reserves the right to restrict account functions and usage, including but not limited to browsing, publishing, and interactive features.

9.2 We take the protection of minors' personal information seriously. Minor users should strengthen their awareness of personal protection and exercise caution when providing personal information, and should do so only with guardian consent and under guardian guidance.

9.3 Minor users and their guardians understand and confirm that if you violate laws or these Terms, you and your guardian shall bear all legal liabilities that may arise in accordance with law.

9.4 Special reminders for minor users

9.4.1 Minors should use MaxAI under the supervision and guidance of their guardians, learn and use the internet properly within reasonable limits, avoid addiction to virtual cyberspace, and develop good internet habits.

9.4.2 To better protect minors' privacy, we specially remind you to be cautious when publishing content containing minors' materials. Once published, it is deemed that you have obtained the rights holder's consent to display minors' portraits, voices, and other information in MaxAI services, and that you permit us to use and process such minors-related content in accordance with these Terms.

9.5 Special reminders for guardians

If your ward uses MaxAI, you as the guardian shall guide and supervise their registration and use. If your ward applies for a platform account, we may deem that you have given your consent.

10. Fees

We incur significant costs in providing MaxAI services. The services we offer may include free and paid features, as displayed on the platform. You may choose free or paid services as needed. You understand and agree that we may adjust pricing and billing methods based on business development needs, and may begin charging for previously free services. We will notify or announce such changes on the platform. For clarity, free services provided through MaxAI shall not be deemed a waiver of our right to charge for such services in the future.

11. Formation, Termination, and Dispute Resolution

11.1 The formation, validity, performance, interpretation, and dispute resolution of these Terms shall be governed by the laws of the People's Republic of China. If any provision of these Terms is held invalid due to conflict with Chinese law, such provision shall be reinterpreted and applied in a manner consistent with the original purpose of the provision to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

11.2 You may terminate these Terms by any of the following means:

(1) Canceling your account through the MaxAI service page when you meet the account cancellation conditions;

(2) Ceasing use and expressly indicating your refusal to accept changes before they take effect;

(3) Expressly indicating that you no longer wish to use MaxAI and meeting the conditions for service termination.

11.3 We may unilaterally terminate these Terms in any of the following circumstances:

(1) Your violation of these Terms, in accordance with the breach provisions;

(2) Your publication of false information, infringement of others' legitimate rights, or other serious illegal acts on MaxAI;

(3) Other circumstances warranting termination of service.

11.4 You understand and agree that termination of these Terms does not automatically relieve you of obligations incurred during the term. If you were in breach before termination, we retain the right to pursue your liability after termination.

12. Miscellaneous

12.1 We may revise these Terms from time to time to improve services or due to changes in laws, regulations, policies, technology, or product features. Revised provisions form an integral part of these Terms. After updates, we will publish the revised version on MaxAI and notify you of changes through our official website (http://maxai.art) or other appropriate means before the revised terms take effect. You may also review the latest version on the website homepage. Your continued use of MaxAI constitutes acceptance of the revised Terms. If you do not accept the revised Terms, you must stop using MaxAI.

12.2 Headings in these Terms are for convenience only and do not affect the meaning or interpretation of any provision.

12.3 You and we are independent entities. Under no circumstances shall these Terms be construed as creating any express or implied warranty, agency, partnership, joint venture, or employment relationship between us.
